Hire Conditions

E & J HIRE is hereinafter referred to as the Owner, and the hired items hereinafter as the equipment.

1. HIRE CHARGES
The Hirer will pay the hire charges from the time and at the rates shown overleaf.
If the Owner is unable to recover the equipment from the Hirer on termination of the hire period specified overleaf, hire charges shall continue until such time as the equipment is restored to the Owner in a clean and serviceable condition against the Owners receipt.

2. HIRE TIME
One-day rate applies to 24 hours.
Two-day rate applies to any 2 consecutive days, delivery/collection included in days of hire.
One-week rate applies to any period from 3 to 7 days, delivery/collection included in days of hire.
Thereafter hire will be charged at 1/7th weekly rate per day.
Certain items as specified have a fixed charge per week, or part thereof.

3. TERMS OF PAYMENT
Non account customers, payment in full on delivery. Account customers, within 30 days of date of invoice.
Interest charged at 3% per month on all accounts not settled as above.

4. DELIVERY / COLLECTION
The Owner will deliver the hired equipment to and collect it from the address specified overleaf.

5. REMOVAL OF THE EQUIPMENT FROM ADDRESS SPECIFIED
The hirer agrees that he/she will not remove the equipment from the address specified overleaf without the authority of the Owner, or from any subsequent authorised address.

6. THE HIRER'S RESPONSIBILITY
The Hirer's responsibility commences on delivery of the equipment by the Owner and ends on collection of the equipment by the Owner and the Hirer is in possession of Owners receipt for the equipment.
The Hirer agrees that he/she will not sell or otherwise part with control of the equipment.
The equipment is hired at the Hirer's own risk and the Hirer shall fully indemnify the Owner in respect of all claims by any person whatsoever. The Hirer is responsible for his/her own insurance.

7. THE OWNER
The Owner shall not be liable for any consequential expense, liability, loss, claim or proceedings, howsoever caused, or arising out of late delivery, non delivery, unsuitability or repossession of the equipment, or any breakdown, or stoppage of same.
The Owner shall have the right at any time and without ascribing a reason or cause thereto to terminate this contract and to repossess the equipment.

8. MAINTENANCE / BREAKDOWN OF EQUIPMENT WHILST ON HIRE
The Hirer shall keep him/herself aware of the state and condition of the equipment at all times and ensure that it remains safe, serviceable and clean.
In the case of breakdown or unsatisfactory working of the equipment the Hirer shall notify the Owner immediately. Under no circumstances shall the Hirer attempt to repair the equipment.

9. LOST, STOLEN, DAMAGED OR UNCLEAN EQUIPMENT
In respect of equipment lost or stolen whilst under the Hirer's responsibility (item 6), or if it cannot be recovered by the Owner, the Hirer agrees to pay the Owner the manufacturers net replacement price for that equipment as if new.
The Hirer agrees to pay the Owner all costs incurred in cleaning and or repairing damaged equipment.

10. DEPOSIT
A deposit may be taken and any sums due to the Owner, whether by way of recovery or re-possession charges, cleaning or repair charges, outstanding hire charges or otherwise will be deducted therefrom before the balance is returned.

11. SIGNING
By signing this contract the Hirer accepts that he/she has fully inspected the equipment and found it to be in good working order.
The Hirer also acknowledges that he/she has been instructed in the safe operation and use of the equipment.

12. VALIDITY
If any provision in these conditions shall be held to be invalid that shall not affect the validity of the remaining terms.
